SEBASTIAN BUSCEMI
A primary focus of my work in Tasmania has been on examining how and why children, particularly in Government institutions, were able to be abused. This led me to uncover that the Department of Education, over a number of decades, had knowingly moved pedophile teachers from school to school following allegations against them. I have found similar systemic practices within child protection, youth justice, health systems and other Government institutions/departments. Central to a person getting justice is knowing why those tasked with protecting them failed to do so. While there has been a lot of progress finding this out, there remain many unanswered questions. My aim is to provide survivors with an avenue to justice, whatever that may look like to them, in a trauma informed and fair way.
The other focus of my work is preventing these systems from continuing to put children at risk. Currently in Tasmania many children in the care of the Government face risks no other Australian child does. Much of what they are exposed to amount to violations of their fundamental human rights. As important as uncovering these systemic practices is to seeking justice for survivors of abuse, it is vital to prevent it continuing. I have taken this on primarily because as a lawyer working with survivors of ‘historic’ abuse I was seeing far too much current abuse.
As part of my work uncovering these systems I also represent whistleblowers who wish to provide information about historic and ongoing practices within Government. I do not believe anyone should face professional or personal risk as a result of speaking out about the abuse of children and seek to provide avenues to avoid that occurring.
